Medical Marijuana vs. Recreational Cannabis in Washington State

5 min read·Green Wellness Team·April 26, 2026

Washington State has robust recreational and medical cannabis programs — but they're not equivalent. For patients with a qualifying condition who use cannabis regularly, the differences are significant enough to make the $175 evaluation cost back within the first month or two of purchases. Here's a complete comparison.

Taxes: the biggest difference

Washington's recreational cannabis is subject to:

  • 37% state cannabis excise tax
  • State sales tax (6.5%)
  • Local sales tax (varies by jurisdiction — up to 4% in some cities)

Total combined tax burden: typically 43–47% on the retail price of recreational cannabis in Washington.

Medical cardholders are fully exempt from all of the above taxes on DOH-compliant products purchased at licensed dispensaries. This exemption runs through June 2029 under HB 1453.

Tax savings example

Patient spending $300/month on recreational cannabis in Seattle (combined tax rate ~47%):

  • Monthly tax paid: ~$141
  • Annual tax paid: ~$1,700

After a $175 medical evaluation (one-time per year), the same patient would save approximately $1,525/year net in the first year — and $1,700/year in subsequent years.

For a patient spending $200/month, the annual net savings (after evaluation cost) are approximately $950 in year one, $1,130 in subsequent years.

Medical patients registered in the WA DOH database can possess 3x the amount recreational users can and are legally permitted to cultivate up to 6 plants at their primary residence.

Product access

Recreational dispensaries in Washington typically carry products up to 35% THC in flower and limited concentrations in other forms. Medical dispensaries (or dispensaries with a medical endorsement) can carry higher-potency products under the medical track. For patients who need higher-potency products for severe symptoms, medical access may be clinically meaningful.

Legal protections

Recreational cannabis use provides no additional legal protections beyond the legalization itself. Medical authorization provides:

  • Affirmative defense against certain cannabis-related charges (with WA DOH registration)
  • Recognition in the WA DOH MMED database, which can be verified by law enforcement
  • Employer notification protections — your medical record and authorization are protected under HIPAA

When recreational makes more sense

If you use cannabis only occasionally (a few times per month), the evaluation cost may not pay off before your annual renewal. For very light users spending under ~$75/month, the math may not work in year one. That said, even light-use patients often find the telehealth renewal at $140/year to be a good deal given the legal protections and possession limits.

The bottom line

If you have a qualifying condition and spend more than about $80–100/month on cannabis, a WA medical authorization will likely save you money in the first year and significantly more in subsequent years. The evaluation is straightforward, same-day, and $175 for new patients.
